Car accident-do we need a lawyer?

My daughter, a new driver, was in a car accident. Her vision was obstructed by a van and didn’t see the other car which hit her. The other driver was walking around before the police arrived and afterward, drove away in his own car. Now we’re being sued for more than $50,000 for his permanent injuries. Can someone really get away with this? Should we get a lawyer or let the insurance handle it? thanks for your help.
