He didn’t say don’t take the breath test AT THE STATION; he said at roadside. Big difference! Implied consent (at least in PA) only refers to a LEGALLY BINDING BAC test, not the portable test OR the “stupid human tricks” by the side of the road.
Also, implied consent specifically mentions “motor vehicles,” so you could theoretically refuse a breath test of any kind on a bicycle
I’m not even leaving the vehicle, let alone walk a line!
Ok, here we go. Forget the ‘Human Tricks’ roadside. If the officer simply states you were too intoxicated to do field sobriety, you’re screwed. That is probable casue alone toi arrrest. DUI on a bike? Check your case law, it can be done. Bike, per the PA Vehicle Code, is a vehicle which can traverse a roadway. Refuse to exit the car duiring a DUI investigation, you get extracted, charged with resisting arrest, and the other ususal charges.
Since we are sharing information, there is also one piece of advice as you refuse to exit your vehicle. As you are removed, if your hand even so much as touches as officers gun, you will be charged with Disarming or attempting to disarm a police or peace officer. Felony charge to go with the resisiting arrest, DUI, Etc. New charges in the PA Crimes Code. Hate to say it, but the deck is, and always will be, stacked in the officers’ favor.

The laws are there to stop people drink driving for a reason moron.
you have to realize if people have a glass of wine they are pretty much close to the limit…those are the people who should view this video…the drunks at the bars i agree shouldnt be driving.
I wonder if this idiot would defend a drunk driver who listened to his advice, got away with drink driving and then killed one of his kids because he he/she was drunk. I think not !!!!!! There is a difference in educating people as to their rights, apposed to educating people on how to get away with offences that endanger your and my family. Remenber, the next person killed by a drunk driver that this fool helped beat the system, could be one of your family members.
No one is saying that someone who is really drunk and/ or hurts someone should get away with it. As the attorney says, we have Constitutional rights and we should know them so that police officers don’t abuse their power.
That kind of emotionally charged rhetoric is the thing that police and state/federal prosecutors will rely on the jury responding to in court so that they can prosecute someone.
The point of the videos is education and the consequences and repercussions of drunk driving accidents lies with the driver, not a lawyer who would defend him.

Prosecutors rely on people like you to be in their juries because you are so easy to charge up emotionally…
The many people who drive while talking on cell phones are a bigger problem than those who drive under the influence. Similar penalties should exist for both things. Otherwise, the result is hypocrisy.
first off if your’ e drunk..you’re not going to remember all this…you will prolly just be an ass and get arrested anyway….which you very well should be if you’re driving drunk.
iheartsedric, for a 23y.old you seem to think you know a lot about this subject, let me ask you this – Have you ever attended a crash to see the drivers dead body which is barely recognisable, or looked into someones eyes as they die, trapped in a mangled car after a drunk driver has hit them, or here’s a good one, have you had to tell mum that there kid has been killed by a drunk driver?Emotionally charged, yes, because i deal with this often. you can talk about it but you won’t understand!!!

You know, usually with age comes wisdom but in your case it actually seems to be the opposite. I’m going to give you some quick advice that may help you in the future;
Your pointless babbling is not going to affect anyone or change anyone’s mind. No one cares what you’ve seen or how many dead bodies you’ve looked at, it makes you no more educated on this topic.

Screw you dude. I have you know that I talk on the cellphone while driving daily but DO NOT text while driving unless I’m in a traffic jam or at a stop sign on a non busy road. And I’ve NEVER had any close calls while on the cell phone and it affects me no different than someone next to me talking. People must suck at driving if they can’t hold a phone while driving.
Hang up and drive, punk.
If you can’t drive one handed you fail at driving and will get in an accident anyway.
So if you refuse and they smell alcohol on your breathe they can’t arrest you?

It varies state by state, but where I live if you refuse it the cop has reasonable suspicion to take you to jail and force you to have a breathalyzer test.
Many states have it set up so that you lose a year of being able to drive if you refuse.
Just remember the best way to prevent all these consequences is to not drive drunk
