He needs to discuss this with his attorney. It will never be thrown out.
Get a different lawyer . . . this one is trying to line his pockets. No, it will not be thrown out. The judge may eventually nail down this phony baloney lawyer he has and force him to bring the defense or face contempt of court charges. But it’s obvious you aren’t going to get a decent defense from this guy anyway, so why play around.
Case by case basis. Some armchair lawyering here. If all the postponements are caused by the court and not his lawyer, then his lawyer could ask for the case to be dismissed. Totally depends on the judge.
Of course I’m talking out of my nose here. In any case, your friend is learning a lession about dwi’s too – not how to get off but that drinking while driving just ain’t right.
